1. Acceptance of Terms
By accessing or using bonega.ai ("Service", "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
2. Description of Service
bonega.ai is an AI-powered video generation platform that allows users to create videos of unlimited total length from text descriptions by chaining successive extensions. Individual generation requests are subject to per-request duration limits described on the applicable plan pages, and each extension consumes plan credits. Our service utilizes advanced artificial intelligence models to generate high-quality video content.
2.1 Service Features
- AI-powered video generation from text prompts
- A single AI pipeline that routes through the best available image and image-to-video tools
- Unlimited video length capabilities
- High-definition output options
- Video extension and editing features
3. User Accounts (web platform only)
This section applies to the bonega.ai web platform. Galaxy mobile apps (PawClip and similar device-anonymous apps) do NOT require account creation; identity in those apps is an anonymous device UUID. To use our web Service, you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your account credentials.
3.1 Account Requirements (web platform only)
- You must be at least 13 years old to use our Service
- Provide accurate and complete registration information (web platform — galaxy mobile apps require no registration)
- Maintain the security of your password (web platform — galaxy mobile apps have no password)
- Accept responsibility for all activities under your account
4. Acceptable Use Policy
You agree not to use our Service for any unlawful or prohibited activities, including:
- Creating content that violates intellectual property rights
- Generating harmful, offensive, or inappropriate content
- Creating deepfakes or misleading content without consent
- Attempting to reverse engineer our AI models
- Overloading or attempting to disrupt our systems
- Using the service for commercial purposes without proper licensing
5. Content and Intellectual Property
5.1 User-Generated Content
You retain ownership of the text prompts you provide. However, by using our Service, you grant us a license to process your prompts for the purpose of generating videos.
5.2 Generated Videos
You own the videos generated through our Service, subject to these Terms. However, you are responsible for ensuring that your generated content does not infringe on third-party rights. Generated videos are hosted at unlisted URLs that are not published, indexed, or discoverable through our Service; only someone who has the exact link can view them, for example when you choose to share it.
5.3 Platform Technology
Our AI models, algorithms, and platform technology remain our exclusive property. You may not attempt to copy, reverse engineer, or extract our proprietary technology.
6. Privacy and Data Use
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
7. Subscription and Payments
7.1 Subscription Plans
We offer various subscription plans with different features and usage limits:
- Standard Plan: Monthly credits with core creation features
- Pro Plan: Higher monthly credits with priority support and queueing
- Optional credit packs: One-time credits for additional usage
7.2 Billing and Refunds
- Subscriptions are billed in advance on a monthly or annual basis
- All fees are non-refundable except as required by law
- If you forgot to cancel a trial, contact us by email within 14 days; refund requests are reviewed case by case for accounts that have used fewer than 150 credits
- We reserve the right to change pricing with reasonable notice
- Failed payments may result in service suspension
7.3 Subscription Cancellation
You may cancel your subscription at any time through the self-service tools provided in your account:
- From the Dashboard Settings (gear icon), click "Cancel Plan"
- From the Pricing page, choose your target paid plan or downgrade at renewal
- Cancellations take effect at the end of your current billing period, and you retain access until then
- You may reactivate your subscription before the billing period ends
These self-service tools are the official and sole method for subscription cancellation. While we may, at our discretion, process cancellation requests received via email or other communication channels, we do not guarantee the processing of such requests and accept no liability for delays or failures in handling manual cancellation requests. You are responsible for using the available self-service cancellation tools.
7.4 Paid Subscription Terms
When you start a paid subscription, pricing and renewal terms are shown before checkout. By proceeding:
- You acknowledge that your subscription renews automatically at the displayed price and billing interval unless canceled before renewal
- Charges are final and non-refundable except where required by law
- It is your responsibility to cancel before renewal if you do not wish to continue with the subscription
- Refund requests for renewal charges may be declined when billing terms were clearly disclosed at checkout
The subscription price, billing frequency, and auto-renewal terms are displayed on the checkout page before any payment information is submitted.
8. Payment Abuse Prevention
To ensure fair access and prevent payment abuse, we implement the following measures:
8.1 Payment Method Tracking
We track payment card identifiers (fingerprints) to prevent fraud and abusive account behavior. By using paid checkout, you agree that:
- We store anonymized payment card fingerprints to detect suspicious use of the same card across multiple accounts
- These fingerprints cannot be used to charge your card or access your payment details
- This tracking is necessary to protect our service and paying users
- Card fingerprints are retained for 12 months for fraud prevention purposes
8.2 Legal Basis
This fraud prevention measure is implemented under contractual necessity (GDPR Art. 6(1)(b)) as a condition of using paid checkout and subscription services.
8.3 Abuse Policy
- Creating multiple accounts to circumvent pricing, limits, or enforcement controls is a violation of these Terms
- We reserve the right to deny checkout access to users who violate these policies
- Payment abuse may result in immediate account suspension or termination
8.4 Financial Remedies for Abuse
If we determine that you created multiple accounts or abused payment systems to obtain services fraudulently, you agree that:
- We may charge the payment method on file for the full retail value of all services obtained through abusive accounts, calculated at the standard Pro plan rate for each account created
- We may issue invoices for the total value of services consumed across all fraudulent accounts, which become immediately due and payable
- We may cancel all subscriptions and revoke all credits associated with abusive accounts without refund
- You are liable for any costs we incur in investigating and remediating the abuse, including administrative fees
- Failure to pay invoices issued under this section may result in referral to a collection agency or legal proceedings under Swiss law
10. Service Availability
While we strive to provide reliable service, we do not guarantee uninterrupted availability. We may perform maintenance, updates, or experience technical issues that temporarily affect service availability.
11. Disclaimers and Limitations
10.1 Service Disclaimer
Our Service is provided "as is" without warranties of any kind. We do not guarantee the accuracy, quality, or suitability of generated videos for any particular purpose.
10.2 Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of our Service.
12. Termination
We may terminate or suspend your account at any time for violation of these Terms. You may cancel your account at any time through your account settings.
13. AI Model Limitations and Responsibilities
Our AI models are continuously improving but may have limitations:
- Generated content may not always match expectations
- Processing times may vary based on complexity and demand
- Models may be updated or changed to improve performance
- Generated content may contain unexpected elements or artifacts
- AI-generated content may inadvertently resemble existing copyrighted material
- You are responsible for reviewing and ensuring the appropriateness of generated content
- We do not guarantee that generated content will be free from biases or inaccuracies
13.1 AI Training and Model Improvement
By using our Service, you understand that:
- Your usage patterns may be analyzed to improve our AI models
- Generated videos may be used for model training (in anonymized form)
- We may implement content filtering and safety measures
- AI model outputs are probabilistic and may vary even with identical inputs
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Switzerland, specifically the Canton of Vaud, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Lausanne, Switzerland.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through our platform. Continued use of our Service constitutes acceptance of updated Terms.
